Official Rules

1. Agreement
Please read these official rules (the “Official Rules”) carefully. They contain important information about your rights and obligations, as well as limitations and exclusions that may apply to you if you enter the School Safe Snack Smarter Sweepstakes (the “Sweepstakes”) sponsored by Treasure Mills Inc., (the “Sponsor”).
By participating in the Sweepstakes, you signify your agreement to these Official Rules and the decisions of the Sponsor. If you do not agree to the Official Rules, you may not enter the Sweepstakes.
2. Sweepstakes Period
The Sweepstakes begins at 12:00:01 AM Eastern Time (“ET”) on August 15, 2021 and ends at 11:59:59 PM ET on January 31, 2022 (the “Sweepstakes Period”).
3. Eligibility
The Sweepstakes is open to legal residents Canada (excluding Northwest Territories, Nunavut, and Yukon) the of who are eighteen (18) years of age or older at the time of entry (“Participant”, “entrant” or “you”).
Employees, officers, directors, agents, representatives or agents of Sponsor, its parent companies and their respective subsidiaries, affiliates, suppliers of prizes, advertising and promotion agencies involved in the administration, development, fulfillment and execution of this Sweepstakes (collectively, the “Sweepstakes Parties”), and the immediate family (spouse, parents, siblings and children) of, and/or those living in the same household of each, are not eligible to enter.
The Sweepstakes is subject to all applicable federal, provincial, territorial, municipal and local laws and regulations. If it is found that a person who does not meet the eligibility criteria set forth in these rules has submitted an entry, that entry will be deemed ineligible. Sponsor reserves the right to verify eligibility requirements. Void outside Canada and wherever else prohibited by law.
4. How to Enter
There is no purchase necessary to enter the Sweepstakes. Making a purchase will not improve your chances of winning.
To enter the Sweepstakes, visit http://snacksmarter.info/ (the “Sweepstakes Website”) during the Sweepstakes Period and follow the online instructions to complete and submit an entry. You will be required to provide your name, email address, city, province and postal code of residence as well as agree to these Official Rules and the Sponsor’s Privacy Policy. Limit of one (1) entry per person during the Sweepstakes Period.
Entries shall be deemed to be submitted by the authorized account holder of the e-mail address associated with the entry. For the purpose of the Official Rules, “authorized account holder” of an e-mail address is defined as the natural person who is assigned to an e-mail address by an Internet service provider or other organization responsible for assigning the submitted email address. Each selected entrant may be required to provide the Sponsor with proof that the selected entrant is the authorized account holder of the email address associated with the selected entry. In the event of a dispute as to the identity of a selected entrant based on the email address, the selected entrant will be deemed to be made by the authorized account holder of the email address at the time of entry.
Entries which are incomplete, illegible or fraudulent are null and void. The Sponsor accepts no responsibility for entries that are lost, misdirected or delayed for any reason. The Sponsor accepts no responsibility for incomplete entries, the incorrect or inaccurate capture of entry information, including but not limited to as a result of malfunction, human error, lost, delayed or garbled Internet or email transmission, omission, interruption, deletion, defect or failures of any telephone, technical, network, online, hardware or software or any combination thereof.
5. How to Earn Bonus Entries:
Once you have completed your Entry, you can earn up to a maximum of five (5) bonus entries (each, a “Bonus Entry” and collectively the “Bonus Entries”) as follows:
• Refer-A-Friend: You will be eligible to earn five (5) Bonus Entries, up to a maximum of five (5) Bonus Entries, for each friend or family member you refer to the Sweepstakes during the Sweepstakes Period in accordance with these Rules and who is eligible to enter the Sweepstakes as set out in Rule 3. To refer a friend or family member, you must enter the name and email address of your friend or family member in the space provided on the Form. You cannot invite the same friend or family member more than one (1) time in this Sweepstakes. In addition, the following rules apply to making a referral in this Sweepstakes:
o You may only provide information of a friend or family member if you have received permission from that person to provide their information to the Sponsor;
o You may only provide information in relation to: (i) a friend with whom you have had direct voluntary two-way communications, and with whom it is reasonable to conclude you have a personal relationship considering shared interests, experiences, opinions and other relevant factors; and/or (ii) a family member to whom you are related by marriage, a common-law partnership, or parent-child relationship, and with whom you have had direct voluntary two-way communications;
o The information of the referred person will not be added to any direct marketing list or used in any direct marketing programs without their consent;
o You and/or the referred person may withdraw consent to use your and/or their personal information at any time; and

6. Prizes/Approximate Retail Value (“ARV”) / Odds
Twenty (20) Grand Prizes are available to be won. Each Grand Prize consists of 6 months of Kumon® Math or Reading Programs.
The twenty (20) Grand Prizes will be allocated by province as follows:
(1) Ontario: Six (6) prizes are available to be won by residents of Ontario.
(2) Alberta: three (3) prizes are available to be won by residents of Alberta.
(3) British Columbia: two (2) prizes are available to be won by residents of British Columbia.
(4) Manitoba: two (2) prizes are available to be won by residents of Manitoba.
(5) Saskatchewan: two (2) prizes are available to be won by residents of Saskatchewan.
(6) Newfoundland and Labrador: one (1) prize is available to be won by residents of Newfoundland and Labrador.
(7) New Brunswick: one (1) prize is available to be won by residents of New Brunswick.
(8) Nova Scotia: one (1) prize is available to be won by residents of Nova Scotia.
(9) Prince Edward Island: one (1) prize is available to be won by residents of Prince Edward Island.
(10) Quebec: one (1) prize is available to be won by residents of Quebec.
The ARV of each Grand Prize is $1,300.00 CAD. The total ARV of all Grand Prizes is $26,000.00 CAD.
Odds of winning will depend upon the total number of eligible entries received from each Province during the Sweepstakes Period. By accepting a prize, prize winners agree to release the Sweepstakes Parties from any and all liability whatsoever for any injuries, losses, or damages of any kind caused by entering the Sweepstakes or for damages of any kind caused by a prize or resulting from acceptance, possession, or use/misuse of any prize awarded.
Prizes are not exchangeable or transferable. There are no substitutions unless specified by the Sponsor. The Sponsor reserves the right in its sole discretion to substitute a portion of a prize with another prize of equal or greater value. Any difference in value between the stated ARV and the actual value of any prize, if lower, will not be awarded.
7. Winner Selection and Notification
A designated representative of the Sponsor will select all potential winners in random drawings conducted at the designee’s offices. Sponsor’s decisions are final. Potential winners will be selected from all eligible entries received from each Province on or about February 2, 2022.
If at the end of the Sweepstakes Period, there are no eligible entries received from residents of any of the provinces listed above in section 5. Prizes/Approximate Retail Value (“ARV”) / Odds, the Sponsor reserves the right, in its sole and absolute discretion to randomly select an eligible entrant for the prize(s) from any other province in a random drawing from the remaining eligible entries submitted and received in accordance with these Official Rules.
All potential winners will be notified by a designated representative of the sponsor at the email provided at the time of entry. The designated representative will make a minimum of two (2) attempts to contact the potential winners within seventy-two (72) hours of the drawing date.
If an eligible potential winner cannot be contacted within seventy-two (72) hours of the drawing date, if the prize is declined, or if there is a return of any notification as undeliverable; then the eligible potential winner may, in the sole and absolute discretion of the Sponsor, be disqualified (and, if disqualified, will forfeit any and all rights to the prize) and the Sponsor reserves the right, in its sole and absolute discretion to randomly select an alternate eligible entrant for the prize in a separate random drawing from the remaining eligible entries submitted and received in accordance with these Official Rules.
No one is a winner unless and until the Sponsor officially confirms him/her as a winner in accordance with these Official Rules.
Before being confirmed as a winner, all potential winners will be required to sign and return, within seventy-two (72) hours of notification, an Affidavit of Eligibility & Liability / Publicity Release form (the “Release"). In addition, each potential winner must correctly answer a time-limited skill-testing question without any assistance in order to become a winner. The skill-testing question may be part of the Release or may be provided separately.
Kumon will contact all winners directly to coordinate enrolment in a Kumon Centre of their choice by July 1, 2022.
8. Limitation of Liability
By participating in the Sweepstakes and as a condition of acceptance of a prize, each entrant, his/her heirs, executors, administrators and assigns, releases, waives, discharges, and holds harmless the Sponsor, its parent companies, and their respective subsidiaries, affiliates, suppliers of prizes, advertising and promotion agencies involved in the administration, development, fulfillment and execution of this Sweepstakes (collectively, the “Released Parties”) from, and against any and all loses, damages, rights, claims, actions, causes of action, personal injury, property damage or death (including without limitation any and all costs and liabilities of any kind including but not limited to lawyer’s fees), and including, without limitation, any such arising from any act of negligence of the Releases Parties, that the entrant now has, or may hereafter have against the Released Parties directly or indirectly resulting from participation of the Sweepstakes or the awarding, acceptance, use, or misuse of a prize. Winners assume all liability for any injury or damage caused or claimed to be caused by participation in this Sweepstakes or use/misuse or redemption of a prize.
9. General
Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the Sweepstakes or in the announcement of the prizes. Sponsor is not responsible for incompatibility of Participants’ hardware, software or browser technology.
The Released Parties are not responsible for: (i) lost, late, misdirected, damaged or illegible entries; or (ii) error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry information by Sponsor on account of technical problems or traffic congestion on the Internet or at any website or any combination thereof; or (iii) any injury or damage to Participant’s or any other person’s computer related to or resulting from participating in the Sweepstakes.
LEGAL WARNING: ANY ATTEMPT BY AN INDIVIDUAL, WHETHER OR NOT A PARTICIPANT, TO DELIBERATELY DAMAGE, DESTROY, TAMPER WITH OR VANDALIZE THE WEBSITE OR INTERFERE WITH THE OPERATION OF THE SWEEPSTAKES, IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND DILIGENTLY PURSUE ALL REMEDIES AGAINST ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. SPONSOR’S FAILURE TO ENFORCE ANY TERM OF THESE OFFICIAL RULES SHALL NOT CONSTITUTE A WAIVER OF THAT PROVISION.
By participating in the Sweepstakes, you (i) agree to be bound by these Official Rules, including all eligibility requirements, and (ii) agree to be bound by the decisions of Sponsor, which are final and binding in all matters relating to the Sweepstakes.
Failure to comply with these official rules may result in disqualification from the Sweepstakes. Sponsor reserves the right to: (i) permanently disqualify from any Sweepstakes it sponsors any person it believes has intentionally violated these Official Rules; and (ii) withdraw a method of entry if it becomes technically corrupted (including if a computer virus or system malfunction inalterably impairs its ability to conduct the Sweepstakes). If for any reason this Sweepstakes is not capable of running as planned due to an infection by a computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, the Sponsor reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Sweepstakes, at which time, Sponsor will conduct a random drawing from among all eligible entries received at the time of the Sweepstakes termination.
10. Disputes
Except where prohibited, Participants agree that any and all disputes, claims and causes of action arising out of, or connected with, the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the Province of Ontario. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant’s rights and obligations, or the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the Province of Ontario without giving effect to any choice of law or conflict of law rules (whether of the Province of Ontario or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the Province of Ontario. The remedy for any claim shall be limited to actual damages, and in no event shall any party be entitled to recover punitive, exemplary, consequential, or incidental damages, including attorney’s fees or other such related costs of bringing a claim, or to rescind this agreement or seek injunctive or any other equitable relief.
THE PARTIES HEREBY WAIVE THEIR RIGHT TO JURY TRIAL WITH RESPECT TO ALL CLAIMS AND ISSUES ARISING OUT OF OR RELATING TO THIS AGREEMENT WHETHER SOUNDING IN CONTRACT OR TORT AND INCLUDING ANY CLAIM FOR FRAUDULENT INDUCEMENT THEREOF.
For Residents of Quebec Only: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
11. Privacy
Personal information collected from Participants will be used by Sponsor to administer this Sweepstakes, including to notify potential winners and to fulfill prizes. In addition, if you opt-in to receive communications we may use this information to send you offers or information from us, our affiliates and from selected sponsors or advertisers (“Marketing Offers”). If you do not wish to receive Marketing Offers, you may opt-out at any time by following the instructions at the bottom of any email Marketing Offer you receive or emailing customercare@treasuremills.com and requesting that your personal information not be used for Marketing Offers.

All requests must be received by February 18, 2021 at 11:59:59 PM ET. Requests received after this time will not be fulfilled.

2. Période du concours
Le concours commence à 00 h 00 min 01 s, heure de l'Est (« HE ») le 15 août 2021 et se termine à 23 h 59 min 59 s HE le 31 janvier 2022 (la « période du concours »).
3. Admissibilité
Le concours est ouvert aux résidents légaux du Canada (à l'exception des Territoires du Nord-Ouest, du Nunavut et du Yukon) qui ont dix-huit (18) ans ou plus au moment de l'inscription (« Participant », « participant » ou « vous »).
Employés, dirigeants, administrateurs, agents, représentants ou agents du commanditaire, de ses sociétés mères et de leurs filiales, sociétés affiliées, fournisseurs de prix, agences de publicité et de promotion respectives impliqués dans l'administration, le développement, la réalisation et l'exécution de ce concours (collectivement, le " Parties au concours »), et la famille immédiate (conjoint, parents, frères et sœurs et enfants) de, et/ou ceux vivant dans le même ménage de chacun, ne sont pas éligibles pour participer.
Le concours est assujetti à toutes les lois et règlements fédéraux, provinciaux, territoriaux, municipaux et locaux applicables. 4. Comment entrer

Pour participer au concours, visitez http://snacksmarter.info/ (le « site Web du concours ») pendant la période du concours et suivez les instructions en ligne pour remplir et soumettre une inscription. Vous devrez fournir votre nom, votre adresse e-mail, votre ville, votre province et votre code postal de résidence, ainsi qu'accepter le présent règlement officiel et la politique de confidentialité du commanditaire. Les inscriptions seront réputées avoir été soumises par le titulaire autorisé du compte de l'adresse e-mail associée à l'inscription. Aux fins du Règlement officiel, le « titulaire de compte autorisé » d'une adresse e-mail est défini comme la personne physique à qui une adresse e-mail est attribuée par un fournisseur de services Internet ou une autre organisation responsable de l'attribution de l'adresse e-mail soumise. Chaque participant sélectionné peut être tenu de fournir au Commanditaire une preuve que le participant sélectionné est le titulaire autorisé du compte de l'adresse électronique associée à la participation sélectionnée. En cas de litige quant à l'identité d'un participant sélectionné en fonction de l'adresse de courriel, le participant sélectionné sera réputé avoir été fait par le titulaire autorisé du compte de l'adresse de courriel au moment de l'inscription.
Les inscriptions incomplètes, illisibles ou frauduleuses sont nulles et non avenues. Le commanditaire n'accepte aucune responsabilité pour les inscriptions perdues, mal acheminées ou retardées pour quelque raison que ce soit. Le commanditaire n'accepte aucune responsabilité pour les inscriptions incomplètes, la saisie incorrecte ou inexacte des informations d'inscription, y compris, mais sans s'y limiter, en raison d'un dysfonctionnement, d'une erreur humaine, d'une transmission Internet ou d'un courrier électronique perdu, retardé ou tronqué, d'une omission, d'une interruption, d'une suppression, d'un défaut ou pannes de tout téléphone, technique, réseau, en ligne, matériel ou logiciel ou toute combinaison de ceux-ci.
5. Prix/valeur au détail approximative (« VDA »)/cotes
Vingt (20) grands prix sont à gagner. Chaque grand prix consiste en 6 mois de programmes de mathématiques ou de lecture Kumon®.
Les vingt (20) grands prix seront attribués par province comme suit :
(1) Ontario : Six (6) prix sont offerts à gagner par les résidents de l'Ontario.
(2) Alberta : trois (3) prix sont offerts à gagner par les résidents de l'Alberta.
(3) Colombie-Britannique : deux (2) prix sont offerts à gagner par les résidents de la Colombie-Britannique.
(4) Manitoba : deux (2) prix sont offerts à gagner par les résidents du Manitoba.
(5) Saskatchewan : deux (2) prix sont offerts à gagner par les résidents de la Saskatchewan.
(6) Terre-Neuve-et-Labrador : un (1) prix est offert à gagner par les résidents de Terre-Neuve-et-Labrador.
(7) Nouveau-Brunswick : un (1) prix est offert à gagner par les résidents du Nouveau-Brunswick.
(8) Nouvelle-Écosse : un (1) prix est offert à gagner par les résidents de la Nouvelle-Écosse.
(9) Île-du-Prince-Édouard : un (1) prix est offert à gagner par les résidents de l'Île-du-Prince-Édouard.
(10) Québec : un (1) prix est offert à gagner par les résidents du Québec.
La VAD de chaque grand prix est de 1 300,00 $ CA. La VAD totale de tous les grands prix est de 26 000,00 $ CA.
Les chances de gagner dépendront du nombre total de participations admissibles reçues de chaque province pendant la période du concours. En acceptant un prix, les gagnants acceptent de dégager les parties du concours de toute responsabilité pour toute blessure, perte ou dommage de toute nature causé par la participation au concours ou pour les dommages de toute nature causés par un prix ou résultant de l'acceptation, possession, ou l'utilisation/abus de tout prix décerné.
Les prix ne sont ni échangeables ni transférables. Il n'y a pas de substitutions, sauf indication contraire du commanditaire. Le commanditaire se réserve le droit, à sa seule discrétion, de remplacer une partie d'un prix par un autre prix de valeur égale ou supérieure. Toute différence de valeur entre la VAD indiquée et la valeur réelle de tout prix, si elle est inférieure, ne sera pas attribuée.
6. Sélection et notification du gagnant
Un représentant désigné du commanditaire sélectionnera tous les gagnants potentiels lors de tirages au sort effectués dans les bureaux de la personne désignée. Les décisions du commanditaire sont finales. Les gagnants potentiels seront sélectionnés parmi toutes les participations admissibles reçues de chaque province le ou vers le 2 février 2022.
Si, à la fin de la période du concours, aucune participation admissible n'a été reçue de résidents de l'une des provinces énumérées ci-dessus à la section 5. Prix/valeur au détail approximative (« VDA »)/cotes, le commanditaire se réserve le droit, à sa seule et la discrétion absolue de sélectionner au hasard un participant admissible pour le(s) prix dans toute autre province lors d'un tirage au sort parmi les autres participations admissibles soumises et reçues conformément au présent règlement officiel.
Tous les gagnants potentiels seront avisés par un représentant désigné du commanditaire à l'adresse e-mail fournie au moment de l'inscription. Le représentant désigné fera au moins deux (2) tentatives pour contacter les gagnants potentiels dans les soixante-douze (72) heures de la date du dessin.
Si un gagnant potentiel éligible ne peut être contacté dans les soixante-douze (72) heures suivant la date du tirage, si le prix est refusé, ou s'il y a un retour d'une notification comme non livrable ; alors le gagnant potentiel éligible peut, à la seule et absolue discrétion du commanditaire, être disqualifié (et, s'il est disqualifié, il perdra tout droit sur le prix) et le commanditaire se réserve le droit, à sa seule et absolue discrétion, de sélectionner un autre participant admissible pour le prix lors d'un tirage au sort distinct parmi les autres participations admissibles soumises et reçues conformément au présent règlement officiel.
Personne n'est gagnant à moins et jusqu'à ce que le commanditaire le confirme officiellement comme gagnant conformément au présent règlement officiel.
Avant d'être confirmés en tant que gagnant, tous les gagnants potentiels devront signer et retourner, dans les soixante-douze (72) heures suivant la notification, un Affidavit d'éligibilité et de responsabilité / Formulaire d'exonération de publicité (la « Décharge »). De plus, chaque Le gagnant potentiel doit répondre correctement et sans aide à une question d'habileté dans un délai limité afin de devenir un gagnant. La question d'habileté peut faire partie de l'Exonération ou peut être fournie séparément.
Les prix seront coordonnés dans un délai d'environ 45 jours après la confirmation des gagnants. Kumon contactera directement tous les gagnants pour coordonner l'inscription dans un centre Kumon de leur choix en 2022.
7. Limitation de responsabilité
En participant au Concours et comme condition d'acceptation d'un prix, chaque participant, ses héritiers, exécuteurs, administrateurs et ayants droit, libère, renonce, décharge et dégage de toute responsabilité le Commanditaire, ses sociétés mères et leurs filiales respectives, affiliés, fournisseurs de prix, agences de publicité et de promotion impliqués dans l'administration, le développement, la réalisation et l'exécution de ce concours (collectivement, les « parties exonérées ») de et contre tous les pertes, dommages, droits, réclamations, actions, causes d'action, de blessures corporelles, de dommages matériels ou de décès (y compris, sans s'y limiter, tous les coûts et responsabilités de quelque nature que ce soit, y compris, mais sans s'y limiter, les honoraires d'avocat), et y compris, sans s'y limiter, ceux résultant d'un acte de négligence des Parties qui renoncent , que le participant a maintenant, ou pourra avoir par la suite contre les parties exonérées résultant directement ou indirectement de la participation au concours ou de l'attribution, de l'acceptation, u se, ou l'abus d'un prix. Le commanditaire n'est pas responsable de toute erreur typographique ou autre dans l'impression de l'offre, l'administration du concours ou dans l'annonce des prix. Les parties exonérées ne sont pas responsables : (i) des inscriptions perdues, en retard, mal acheminées, endommagées ou illisibles ; ou (ii) une erreur, une omission, une interruption, une suppression, un défaut, un retard dans les opérations ou la transmission, le vol ou la destruction ou l'accès non autorisé ou la modification du matériel d'entrée, ou pour des dysfonctionnements techniques, réseau, téléphoniques, électroniques, informatiques, matériels ou logiciels de quelque nature que ce soit, ou transmission inexacte ou défaut de réception des informations de participation par le Sponsor en raison de problèmes techniques ou de congestion du trafic sur Internet ou sur tout site Web ou toute combinaison de ceux-ci ; ou (iii) toute blessure ou dommage à l'ordinateur du Participant ou de toute autre personne lié à ou résultant de la participation au Concours.

LE NON-APPLICATION PAR LE COMMANDITAIRE D'UNE CONDITION DE CE RÈGLEMENT OFFICIEL NE CONSTITUE PAS UNE RENONCIATION À CETTE DISPOSITION.
En participant au concours, vous (i) acceptez d'être lié par le présent règlement officiel, y compris toutes les conditions d'éligibilité, et (ii) acceptez d'être lié par les décisions du commanditaire, qui sont définitives et exécutoires pour toutes les questions relatives au concours. .
Le non-respect de ces règles officielles peut entraîner la disqualification du concours. 9. Litiges
Sauf dans les cas où cela est interdit, les participants conviennent que tous les litiges, réclamations et causes d'action découlant de ou liés au concours ou à tout prix attribué seront résolus individuellement, sans recourir à aucune forme de recours collectif, et exclusivement par le tribunal situé dans la province de l'Ontario. Pour les résidents du Québec seulement : Tout litige concernant la conduite ou l'organisation d'un concours publicitaire peut être soumis à la Régie des alcools, des courses et des jeux pour décision. Tout litige relatif à l'attribution d'un prix ne peut être soumis à la Régie que dans le but d'aider les parties à en arriver à un règlement.

Les renseignements personnels recueillis auprès des participants seront utilisés par le commanditaire pour administrer ce concours, y compris pour informer les gagnants potentiels et pour remettre les prix.
